Description
Article X. 15.08.340 - Substandard Buildings (HSC § 17920.3), Section C. declares a substandard building and public nuisance any nuisance, as defined in Section 15.08.170. Section 15.08.170 provides “NUISANCE is one or more of the following: 1.A public nuisance known at common law or in equity or jurisprudence.” The motion sensor alarms throughout front, side and back of 2626 Beal Ave that alarms at a high decibel, repeatedly, and is static for oftentimes hours on end impacts all surrounding neighbors as it prevents and interferes with their use and enjoyment of their homes and negatively impacts the fair market value of these surrounding homes, has been repeatedly reported to the City of Oakland police and Code enforcement, and therefore is a public nuisance under common law, equity and City Ordinance.
Section 15.08.350 authorizes the Building Official to issue a declaration of public nuisance—substandard and statement of action directed to the record owner of the property. Accordingly, please take appropriate and immediate action.
