Section 15.08.170 provides “NUISANCE is one or more of the following: 1.A public nuisance known at common law or in equity or jurisprudence.” The motion sensor alarms throughout front, side and back of 2626 Beal Ave that alarms at a high decibel, repeatedly, and is static for oftentimes hours on end impacts all surrounding neighbors as it prevents and interferes with their use and enjoyment of their homes and negatively impacts the fair market value of these surrounding homes, has been repeatedly reported to the City of Oakland police and Code enforcement, and therefore is a public nuisance under common law, equity and City Ordinance.

    Section 15.08.350 authorizes the Building Official to issue a declaration of public nuisance—substandard and statement of action directed to the record owner of the property. Accordingly, please take appropriate and immediate action.

    There has been debris dumped on both sides of the street. The side walk is blocked from strollers and wheelchairs. The debris is in the street and the freeway lights are off at night so it’s a safety hazard because you can see the trash in the road as you drive underneath at night.
